Terms of Service

These terms govern your use of Daily 8. They describe what you can expect from us, what we expect from you, and the statutory consumer rights that apply if you are based in the United Kingdom or the United States.

No. 01

Who you are contracting with

There are two parties on our side of your subscription, and it matters which one does what:

  • The operator (service provider). Daily 8 is operated as a sole-trader business (개인사업자 / individual business) registered in the Republic of Korea. The operator creates and delivers the daily lessons and is your counterparty for the service itself. The operator is an individual sole trader, not a limited company or incorporated entity.
  • Lemon Squeezy (Merchant of Record / seller for payment). Your payment is handled by Lemon Squeezy as our Merchant of Record. That means Lemon Squeezy is the legal seller to you for the payment transaction: you buy from Lemon Squeezy, and Lemon Squeezy licenses the Daily 8 product from the operator. Lemon Squeezy runs the checkout, processes the card, calculates and remits any sales tax / VAT / GST, and handles chargebacks and refunds. See section 6 (“Price, billing and auto-renewal”) for what this means in practice.

In plain terms: the operator is responsible for the lessons and the service; Lemon Squeezy is the seller of record for the money side. Lemon Squeezy's own terms of service govern the payment transaction in addition to these Terms.

Acceptance of these terms

By completing checkout for a Daily 8 subscription you agree to these Terms of Service, the Trial & Refund Policy, and the Privacy Policy. If you do not agree, do not complete checkout.

We record the date and time of your acceptance, the version of these terms in force at that moment, and the payment confirmation from Lemon Squeezy (our Merchant of Record) as evidence of agreement.

No. 03

What the service is

Daily 8 is a paid digital subscription that delivers one short language-learning message per day to the WhatsApp number you provide at checkout. Messages are sent at approximately 8 AM in the subscriber's local timezone and contain short text and, where relevant, supporting media (audio clips or images).

Daily 8 is an editorial subscription, not a certified language course. We do not guarantee any specific learning outcome or proficiency level.

No. 04

Eligibility

You must be at least 18 years old to subscribe. We do not knowingly sell to children. If you are subscribing on behalf of someone else (a gift), the recipient must also meet the age requirement.

Where the service is offered. Daily 8 is aimed at and marketed to consumers resident in the United Kingdom and the United States, and these Terms are written around UK and US consumer law. The product is delivered digitally over WhatsApp, so people in other countries may be able to complete checkout. We do not block sign-ups by phone-number country code, because doing so would shut out legitimate UK and US customers living or travelling abroad. Where the law of your country of residence gives you mandatory consumer-protection rights, those rights still apply (see section 17, Governing law). Lemon Squeezy, as Merchant of Record, blocks purchases from sanctioned or embargoed jurisdictions and applies the correct local tax at checkout wherever you are.

No. 05

Your account and subscription

In our WhatsApp-first model, your phone number is the identifier for the daily messages, and your optional email is a billing and recovery channel. You manage your subscription — including cancellation — from your profile / account page, where cancelling is a single tap (see section 8). Payment details (your card) are held and updated through Lemon Squeezy, our Merchant of Record; we never see or store your card number.

You are responsible for: keeping your WhatsApp number active, keeping your payment details up to date through Lemon Squeezy, and notifying us promptly if your phone number changes.

No. 06

Price, billing and auto-renewal

The subscription price is $49 per year (USD) or £39 per year (GBP), charged as a single annual payment at the end of the 7-day free trial.

Payment, taxes and Merchant of Record. Payment is taken by Lemon Squeezy, which acts as our Merchant of Record. As Merchant of Record, Lemon Squeezy is responsible for calculating, collecting, and remitting any sales tax, VAT, or GST due on your purchase, anywhere in the world, and it adds that amount at checkout where required. The operator does not separately assess or self-remit consumer sales tax on these transactions. Card data is handled entirely by Lemon Squeezy (and its payment sub-processor); we do not see or store your card number.

Auto-renewal disclosure (important). Your subscription renews automatically at the end of each annual term at the price then in effect, charged to the payment method on file with Lemon Squeezy. We disclose this clearly at checkout before you pay, and we send a reminder email at least 7 days before each renewal charge. You can cancel at any time from your profile as described in section 8 below; cancellation before the next renewal date stops all future charges.

This disclosure is provided to comply with the US Restore Online Shoppers' Confidence Act (ROSCA) and US state automatic renewal laws (including California's Automatic Renewal Law), and with UK consumer transparency requirements.

No. 07

7-day free trial

New subscribers receive a 7-day free trial. You will not be charged during the trial. If you do not cancel before the end of day 7, the first annual charge ($49 or £39) is taken on day 8 and your paid subscription begins.

We send a reminder email 24 hours before the first charge so the end of the trial is never a surprise. Cancelling during the trial is one tap from your profile / account page — see the Trial & Refund Policy.

No. 08

How to cancel

You can cancel at any time, with no fees or penalties, directly from your profile:

  • Sign in to your account / profile page, open the Subscription section, and tap Cancel subscription — one tap stops the next renewal immediately. We confirm on screen and by email.

Cancellation is self-service from your profile and is at least as easy as signup. We do not require an email, a phone call, a retention conversation, or any other step that isn't available at signup. (If you ever cannot reach your profile, you can email team.byzzle@gmail.com for help, but the primary, intended cancellation route is the one-tap button on your profile.) This is intended to satisfy the “click-to-cancel” standard under California ARL and comparable US state laws, and the cancellation-method transparency expected under UK consumer law.

No. 09

UK consumers — your statutory rights

If you are resident in the United Kingdom, you have specific statutory rights that apply on top of these Terms and that we cannot exclude:

  • 14-day right of withdrawal under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, beginning the day the contract is concluded. See the Trial & Refund Policy for how this right interacts with the 7-day free trial and the express-consent rules for digital services that begin during the cooling-off period.
  • Consumer Rights Act 2015 — the digital content we supply must be of satisfactory quality, fit for purpose, and as described. If it is not, you are entitled to a repair, replacement, or refund as the Act provides.

US consumers — your rights

If you are resident in the United States, the following consumer-protection statutes apply to your subscription:

  • Restore Online Shoppers' Confidence Act (ROSCA), 15 U.S.C. §§ 8401–8405 — we disclose the material terms of the recurring charge clearly before purchase, obtain your express informed consent, and provide a simple cancellation mechanism.
  • State automatic-renewal laws, including California's Automatic Renewal Law (Cal. Bus. & Prof. Code §§ 17600 et seq., as amended by AB 390) — we obtain affirmative consent to the auto-renewal, provide a clear acknowledgement of the renewal terms, and offer cancellation that is as easy as signup (“click-to-cancel” parity). Similar laws in other states (e.g., New York, Illinois, Oregon) apply where you reside.

No. 11

Refunds

Our refund position is summarised here and described in full in the Trial & Refund Policy. In short: no charge if you cancel before the end of the 7-day trial; statutory withdrawal rights for UK consumers within 14 days; and discretionary refunds for billing errors, accidental purchases, and genuine service issues. Because Lemon Squeezy is the Merchant of Record, approved refunds are processed back to your original payment method through Lemon Squeezy.

No. 12

Acceptable use

You agree not to use Daily 8 to: scrape or republish the daily messages, automatically forward content to bots or third-party channels, resell or share your subscription, or harass support staff. We may suspend or terminate subscriptions that breach these rules; see section 14 below.

No. 13

Intellectual property

We retain all rights in the daily content, the Daily 8 brand (including the name, marketing taglines, otter mascot, and all derivative artwork), the curriculum structure, and the editorial selection. Nothing in these Terms transfers any of those rights to you.

For the duration of your subscription, we grant you a personal, non-transferable, non-exclusive licence to read, save, and quote the daily messages for personal, non-commercial use.

Disclaimers and limits

We provide Daily 8 with reasonable care and skill but make no guarantee of any particular learning outcome. To the maximum extent permitted by applicable consumer-protection law, our aggregate liability arising out of or in connection with the subscription is limited to the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded — including liability for death or personal injury caused by negligence, fraud, or breach of the consumer-protection rights described in sections 9 and 10.

No. 15

Termination by us

We may suspend or terminate your subscription for non-payment, repeated breach of the acceptable-use rules, fraudulent chargebacks, or other serious abuse. Where we terminate without cause, we refund the unused portion of the current annual term on a pro-rata basis. Where we terminate for cause, no refund is owed, except where statutory consumer rights require otherwise.

Changes to these Terms

We may update these Terms from time to time. For material changes, we will notify you by email and in-message banner at least 30 days before they take effect. If you do not accept the changes, you may cancel and receive a pro-rated refund of any unused portion of the current annual term.

No. 17

Governing law and disputes

These Terms — covering the Daily 8 service provided by the operator — are governed by the laws of the Republic of Korea, where the sole-trader operator is registered. The separate payment transaction is provided by Lemon Squeezy as Merchant of Record and is additionally governed by Lemon Squeezy's own terms of service.

Important consumer-rights override: nothing in this clause deprives you, as a consumer, of the protection of the mandatory consumer-protection laws of the country (and, for the US, the state) in which you reside. This applies to consumers in the United Kingdom and the United States — our primary markets — and equally to a consumer resident elsewhere who lawfully completes a purchase. You may bring proceedings in the courts of your country of residence, and the mandatory consumer-protection rules of your home jurisdiction apply alongside Korean law.
